What is the daily rate for GST late filing fees?

For active returns (GSTR-1 & GSTR-3B), the standard late fee is ₹50 per day (₹25 CGST + ₹25 SGST). For Nil returns (returns with zero tax liability or transactions), the late fee is reduced to ₹20 per day (₹10 CGST + ₹10 SGST).

Is there a maximum cap on GST late fees?

Yes. The maximum cap for GSTR-1 and GSTR-3B is rationalized as follows: 1) Nil returns: Capped at ₹500. 2) Taxpayers with turnover up to ₹1.5 Crore: Capped at ₹2,000. 3) Turnover between ₹1.5 Crore and ₹5 Crore: Capped at ₹5,000. 4) Turnover above ₹5 Crore: Capped at ₹10,000.

How is interest calculated on delayed tax payments?

If you fail to pay your tax liability on time, you must pay interest at the rate of 18% per annum on the net tax liability paid in cash (excluding ITC). The interest is calculated daily, starting from the day after the due date until the day of payment.

Can I pay GST late fees using my Input Tax Credit (ITC)?

No. Under statutory GST rules, all late fees and interest penalties must be paid strictly in cash through the Electronic Cash Ledger. You cannot utilize the Electronic Credit Ledger (ITC) to discharge penalty liabilities. This ensures full compliance with the latest regulations, allowing you to estimate values correctly and avoid common filing errors.

The Logic Explained Simply

  • The Concept: Taxpayers who delay filing GST returns must pay a daily late fee, which is capped at various levels based on business turnover and return type. If there is an unpaid tax liability, an additional interest of 18% per annum is levied on the net tax due, calculated on a daily basis.
  • The Formula:

Late Fee = Days Late × Daily Rate (capped at the maximum limit for the selected return and taxpayer category)

Interest = Unpaid Tax × (18 / 100) × (Days Late / 365)

Total Penalty = Late Fee + Interest

Suppose you file an active GSTR-3B return 10 days late under a Regular Taxpayer status (AATO <= 1.5 Cr), with a pending tax liability of ₹50,000.

  • Daily Late Fee Rate = ₹50/day (₹25 CGST + ₹25 SGST)
  • Late Fee = 10 Days × ₹50/day = ₹500
  • Daily Interest Rate = 18% / 365 = 0.0493% per day
  • Unpaid Tax Interest = ₹50,000 × 18% × (10 / 365) = ₹247
  • Total GST Penalty = Late Fee (₹500) + Interest (₹247) = ₹747
