Can both husband and wife claim tax benefits on a joint home loan?

Yes, if a husband and wife jointly own the property and are co-borrowers on the home loan, both can claim tax deductions. They can each claim up to ₹1.5 Lakhs under Section 80C for principal repayment and up to ₹2 Lakhs under Section 24b for interest, in proportion to their share in the home loan.

What is the difference between Section 24b and Section 80C for home loans?

Section 80C applies to the principal repayment portion of your EMI (up to a limit of ₹1.5 Lakhs per year). Section 24b applies to the interest component of your EMI (up to ₹2 Lakhs per year for self-occupied properties). Both deductions can be claimed in the same tax year.

Under what conditions can I claim the extra Section 80EEA benefit?

Section 80EEA allows an additional deduction of up to ₹1.5 Lakhs per year on home loan interest. To qualify, you must be a first-time homebuyer, the stamp value of the property must not exceed ₹45 Lakhs, and the loan must have been sanctioned between April 1, 2019, and March 31, 2022.

Can I claim home loan tax benefits if the property is under construction?

No, you cannot claim tax deductions for principal or interest payments while the property is under construction. However, interest paid during the pre-construction period can be accumulated and claimed in five equal annual installments starting from the year construction is completed.

Are home loan tax benefits available under the New Tax Regime?

No. Under the New Tax Regime (default for FY 2025-26 & FY 2026-27), home loan tax deductions under Section 80C (principal), Section 24b (interest on self-occupied property), and Section 80EEA are not available. These deductions can only be claimed if you opt for the Old Tax Regime.

The Logic Explained Simply

  • The Concept: Homeowners in India can lower their taxable income by claiming the principal component of their EMIs under Section 80C and the interest component under Section 24b. If the property is your first home and the loan is within specific limits, you can claim an additional deduction under Section 80EEA.

  • Section 80C Benefit = min(Principal Paid in Year Y, ₹1,50,000)

  • Annual EMI = ₹43,391 × 12 = ₹5,20,692
  • For Year 1, the payment breakdown is:
  • Interest Paid = ₹4,21,290
  • Principal Paid = ₹99,402
  • Tax benefits (at 30% slab, assuming not eligible for 80EEA as loan > 45L):
  • Section 80C deduction (Principal) = ₹99,402 (fully eligible as it is under ₹1,50,000)
  • Section 24b deduction (Interest) = ₹2,00,000 (capped at the maximum limit of ₹2,00,000)
  • Total Deductions = ₹99,402 + ₹2,00,000 = ₹2,99,402
  • Total Tax Saved = ₹2,99,402 × 30% = ₹89,821
